POWER ACTION AGAINST CITY HEARD MONDAY
RESTRAINING ORDER FIGHT TO BE WAGED COURT, SEWARD
The case of John H. Graff, Elizabeth H. Graff and Elizabeth G. Knight, as owners of Seward Light & Power, against the Town of
Seward, its officials; Gov. John W. Troy, as PWA representative for the Territory of Alaska, will be heard in open court in Seward
Monday. Case will be called at 10 a. m.
Governor Troy will be represented by United States District Attorney J. W. iKehoe through direction of the United States Attorney General, Washington, D. C. The city and its representatives will be defended, by Attorney L. V. Ray.
Attorneys for plaintiffs are E. F. Medley and W. H. Hodge.

Named in the summons for action are D. C. Brownell, mayor; H. S. Balderston, treasurer; E. D. Webb. clerk; G. R. Manthey, John W. Blase. Donald D. Davis, Thorwald Osbo. T. H. Jones. Charles T. Gilliland. councilmen, representing; the corporate Town of Seward.
Action is directed against the building of a municipal power plant as authorized by Public Act No. 63, complaint alleging fraud
and conspiracy on the part of city officials in obtaining passage of said act, particularly alleging "that said defendant Brownell
and the above-named defendants who are members of the Town Council of the Town of Seward, entered into conspiracy to injure
the plaintiffs by the destruction of their business in the Town of Seward, through illegal and fraudulent means."
Would Halt Work
Allegation is also made that Mayor Brownell made "false and fraudulent statements concerning the business of the plaintiffs" he
fore committees of Congress. With permanent injunction against the use of PWA or any funds whatsoever as ultimate objective, pending final hearing temporary injunction is sought against "proceeding with or making effective any act or transaction in connection with or in furtherance , of the construction" of the proposed plant.
Judge Simon Hellenthal, Derick Lane, district court clerk; Mrs. Peggie Johnson, court stenographer, arrived from Valdez on the SS Alaska. Attorneys Medley and Hodge were also stealer arrivals. Power plant injunction action will mark the; opening of one week of court sessions.
